1. Who may use the Service
You must be at least 18 years old to create an account or make a purchase. If you use the Service on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.
2. Your account
- Provide accurate information and keep it up to date.
- Keep your login details confidential. You are responsible for activity under your account.
- Accounts are for one person. Do not share your login or let others access your courses through your account.
- Tell us promptly at admin@cybertekie.com if you believe your account has been accessed without permission.
3. Plans, purchases, and billing
Current prices are displayed on the Pricing page and at checkout. Prices shown at checkout are the prices that apply to your purchase. Prices may not include applicable taxes, which may be added at checkout where required.
We offer, or may offer:
- Single-course purchases: access to an individual course for a one-time price displayed on the Pricing page, the course page, and at checkout, on the access terms described in Section 5.
- Subscriptions: recurring access plans, when launched and made available for purchase, for the amount and billing frequency disclosed on the Pricing page and at checkout, on the terms described in Section 4. A plan described as coming soon is not available to purchase until we make it available at checkout.
- Corporate training: training for organizations, governed also by the applicable corporate agreement or order, as described in Section 24.
Payments. Payments are processed through our online store and a third-party payment processor. We do not store your full card number. You agree to provide accurate payment information and to keep it up to date.
Price changes. We may change prices from time to time. A price change will not affect a single-course purchase you have already completed. For subscriptions, we will give you notice of a price change before it takes effect for a future billing period, and you may cancel before the new price applies, as described in Section 4.
4. Subscriptions and recurring billing
This section applies to subscription plans when they are launched and made available for purchase.
- Amount and frequency disclosed at checkout. Before you complete a subscription purchase, the checkout will disclose the amount to be charged, the billing frequency, and the renewal terms. By completing the purchase, you authorize us and our payment processor to charge that amount at that frequency to your payment method until you cancel.
- Automatic renewal. Your subscription will renew automatically at the end of each billing period, and your payment method will be charged the then-current price for the next period, until you cancel.
- How to cancel. You may cancel through My Account -> Subscriptions, or by contacting us at admin@cybertekie.com.
- Effect of cancellation. Cancellation stops future renewals. Cancellation takes effect at the end of the paid billing period, and your access continues through the end of that paid period, unless we state otherwise in these Terms.
- Refund treatment. Refunds for subscription purchases and renewals are governed by Section 6.
- Failed payments. If a renewal charge fails, we may retry the charge, suspend access, or cancel the subscription after notice, as permitted by law.
The checkout disclosure for a subscription will be in substantially the following form:
“By starting your subscription, you authorize CyberTekie to charge the amount and frequency shown at checkout until you cancel. Cancel through My Account → Subscriptions. Cancellation stops future renewals, and access continues through the end of the paid billing period. Taxes may apply.”
5. Single-course access, course content, and release schedule
- Access period. A single-course purchase gives you access to that course for 12 months from the date of purchase.
- Future modules included. All future modules in that course are included in your single-course purchase as they are released during your access period. For example, where a course is released in stages, later modules in that same course (such as Modules 2-6 of a staged course) are included as released, and you do not need to buy the rest of that same course separately.
- Staged releases. Some courses are released in stages. Planned content, topics, and release timing may change. Learning paths or courses marked “coming soon” are not yet available.
- Updates and changes. We may update, improve, reorganize, or retire content to keep it accurate and current.
- Course retirement or early discontinuation. If we retire or discontinue a course before the end of your paid access period for that course, we will provide a prorated refund for the unused portion of that access period, or another remedy consistent with Section 6 and our Refund Policy. Where we offer a reasonable alternative, such as access to replacement content of comparable value for the remainder of your access period, we will tell you how to choose between the alternative and any refund that applies.
- Downloadable resources. Where a course provides downloadable resources, you may download and use them for your personal learning in connection with the course. You may not redistribute, resell, share, or publicly post downloadable resources. Access through the Service to downloadable resources may end when your course access ends, except that materials you have already lawfully downloaded may be retained for your personal use unless we state otherwise for a particular resource.
Full details on refunds are in our Refund Policy, which forms part of these Terms. If there is a conflict between Section 6 and the Refund Policy about refunds, we will apply the provision that is consistent with the 7-day refund policy described in Section 6, subject to Section 24 for corporate training.
6. Refunds
You can request a full refund within 7 days of purchase, as follows:
- Initial subscription purchases: full refund if requested within 7 days of the initial purchase.
- Single-course purchases: full refund if requested within 7 days of purchase.
- Annual renewals: the 7-day refund window applies to an annual renewal, measured from the date of that annual renewal charge.
- Monthly renewals: monthly renewals are not refundable after the initial purchase period; cancel to stop further charges, and access continues through the end of the paid billing period.
After the applicable 7-day window, subscriptions can be cancelled at any time and will stop renewing at the end of the current paid period; except as stated in Sections 5 and 12, we do not provide partial refunds for unused time in a billing or access period, or for single-course purchases after the 7-day window.
Downloaded materials. We may deny or reduce a refund, to the extent permitted by law, where substantial course materials have been downloaded or copied in bad faith in order to obtain the substance of a course while claiming a refund. Downloading materials for ordinary personal study during your access period is not, by itself, bad faith.
Corporate training. Refunds for corporate training are governed by the applicable corporate agreement or order. If that agreement or order addresses refunds, it controls over this Section in the event of a conflict, as described in Section 24.
How to request a refund. Email admin@cybertekie.com within the applicable window with the email address on your account and your order number. Approved refunds will be issued to the original payment method where practicable. When a refund is issued, access to the refunded course or subscription ends.
7. Educational purpose; no professional advice
The Service is for educational purposes. Courses may use fictional organizations and teach practical analysis. Nothing in the Service is legal, regulatory, compliance, or other professional advice, and you should consult a qualified professional about your own situation.
Unless a course explicitly says otherwise, our courses are not official preparation courses for, or endorsed by, any certifying body. Completion certificates issued by CyberTekie recognize completion of a CyberTekie course and are not professional certifications or licenses. If you claim continuing professional education (CPE) credit, you are responsible for following your certifying body’s rules.
8. Ethical and lawful use of security skills
Some courses teach offensive and defensive security techniques. You agree to use what you learn only lawfully and ethically, and to test only systems you own or have explicit, written permission to test. You are solely responsible for how you use any technique, tool, or information from the Service.
9. Acceptable use
You agree not to:
- Copy, download (except where downloads are provided), record, resell, share, or publicly post course videos, labs, templates, quizzes, or other materials.
- Share quiz answers, answer keys, or lab solutions in a way that undermines assessments.
- Attempt to access accounts, systems, or data on the Service that you are not authorized to access, or probe, scan, or test the Service’s security.
- Interfere with the Service, introduce malicious code, or use bots or scrapers to access content.
- Use the Service to harass others or to post unlawful, infringing, or abusive content.
10. Intellectual property and your license
The Service and its content, including videos, scripts, case files, labs, templates, quizzes, text, graphics, and branding, are owned by CyberTekie or its licensors and are protected by intellectual property laws. While you have access, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the content for your own non-commercial learning. Work products you create in labs are yours to keep and show in your portfolio, but this does not give you rights to redistribute our underlying templates or materials.
11. Content you submit; moderation and removal
If you submit lab work, assignments, comments, reviews, or messages, you keep ownership of it. You give us a non-exclusive license to host, store, and use it to operate the Service, provide feedback, and assess your progress. Do not submit confidential or sensitive information belonging to a real employer or client.
We may moderate, remove, or restrict access to submitted content, and may suspend accounts, where content violates these Terms, is unlawful, infringing, abusive, harassing, deceptive, or harmful, interferes with assessments or the Service, or where removal is reasonably necessary to protect users, CyberTekie, or third parties or to comply with law. Where practicable and permitted by law, we may give notice and an opportunity to correct, but we are not required to do so for serious or repeated violations.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, misuse the Service, engage in fraudulent payment activity, or if required by law. Sections that by their nature should survive termination will survive.
If we permanently terminate a paid Service for reasons unrelated to your breach, we will provide a prorated refund for the unused portion of the applicable prepaid access period, unless prohibited or unnecessary under applicable law.
13. Account deletion and effect on course access
You may request deletion of your account by contacting us at admin@cybertekie.com. Deletion of your account ends your access to courses, subscriptions, progress records, certificates, and downloadable resources through the Service, and we may be unable to restore them after deletion. Account deletion does not entitle you to a refund except as stated in Sections 5, 6, and 12 or as required by law. Certain records may be retained as required by law, for accounting and security purposes, or as described in our Privacy Policy.
14. Fraudulent payments and chargebacks
You agree not to use a payment method you are not authorized to use. If we reasonably believe a payment is fraudulent, unauthorized, or disputed, we may suspend or terminate access, withhold certificates, and investigate. If you initiate a chargeback or payment reversal, we may suspend access to the affected course or subscription while the dispute is resolved and may provide order and access records to the payment processor. If a chargeback is reversed or resolved in our favor, we may restore access. Please contact us first at admin@cybertekie.com so we can try to resolve a billing issue.
15. Copyright infringement reporting
If you believe content on the Service infringes your copyright, please send a notice to admin@cybertekie.com with:
- Your name and contact information.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing and where it is located on the Service.
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury where required by law, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
- Your physical or electronic signature.
We will review notices and may remove or disable access to the identified material and, where appropriate, terminate repeat infringers. If you believe your content was removed in error, you may send a counter-notice to the same address identifying the removed material, explaining why you believe it was removed in error, and providing your contact information and consent to be contacted about the dispute.
16. Export control and sanctions compliance
Cybersecurity techniques, tools, and information can be subject to export control and sanctions laws. You agree to comply with applicable export control and sanctions laws and not to use, export, re-export, transfer, or disclose controlled techniques, tools, software, or information from the Service in violation of those laws, or to or for the benefit of a person, organization, or destination subject to applicable sanctions or restrictions.
17. Third-party services
The Service relies on third-party tools and providers, such as our learning management system, store, payment processor, and analytics and security services. Their terms and privacy practices apply to their services. Our Privacy Policy explains how we handle your information.
18. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular result, including employment, promotion, or passing any certification exam, and we do not guarantee the Service will be uninterrupted or error-free.
19. Limitation of liability
To the fullest extent permitted by law, CyberTekie will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid CyberTekie during the 12 months preceding the event giving rise to the claim or the amount paid for the affected course. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
20. Indemnity
You agree to indemnify and hold harmless CyberTekie from claims arising out of your misuse of the Service, your violation of these Terms, or your misuse of security techniques learned through the Service.
21. Governing law and disputes
These Terms and any dispute arising out of or relating to these Terms or the Service are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to any rights that cannot be waived under applicable law, you agree that the state and federal courts located in Dallas County, Texas, will have exclusive jurisdiction and venue over any such dispute, and you consent to the personal jurisdiction of those courts.
22. Electronic notices and communications
By using the Service, creating an account, or making a purchase, you agree that we may send you notices and communications electronically, including by email to the address on your account and by posting on the Service. These include purchase confirmations, renewal and price-change notices, account and security notices, and notices of changes to these Terms. You agree to keep your email address up to date. Electronic notices are deemed given when sent or posted, as permitted by law.
23. Non-waivable consumer rights
Nothing in these Terms limits rights that cannot be waived under applicable law.
24. Order of precedence for corporate-training agreements
If you or your organization have a separate signed corporate-training agreement, order form, or statement of work with CyberTekie, that corporate agreement controls over these Terms in the event of a conflict, but only for the corporate training covered by that agreement or order. These Terms continue to apply to matters the corporate agreement does not address and to your individual use of the Service.
25. Force majeure
Neither party will be liable for delay or failure to perform, other than a payment obligation for amounts already due, where the delay or failure results from events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, embargoes, government action, labor disputes, or failures of power, telecommunications, hosting, or payment infrastructure. The affected party will use reasonable efforts to resume performance.
26. Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms, the Service, or our rights and obligations, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our business or assets, or by operation of law, with notice to you where required by law.
27. No waiver; severability
Our failure to enforce a provision of these Terms is not a waiver of that provision or of our right to enforce it later. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full effect.
28. Entire agreement
These Terms, together with our Privacy Policy, Refund Policy, any checkout terms presented at purchase, and any applicable corporate agreement subject to Section 24, are the entire agreement between you and CyberTekie about the Service and supersede prior or contemporaneous agreements, communications, and proposals, whether written or oral, about the Service.
29. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and notify you by email or on the Service, as described in Section 22. Continued use after changes take effect means you accept the updated Terms.
